Terms of Service for Evap Mail

1. Acknowledgement

This End-User License Agreement ("EULA") is concluded between you and the individual providing Evap Mail ("we," "us," or "our"), not with Apple or Google. You acknowledge that Apple and Google are not responsible for the application or its content. The use of this application must comply with the respective Apple Media Services Terms and Conditions and Google Play Terms of Service.

2. Scope of License

The license granted to you for Evap Mail is a non-transferable license to use the application on any device you own or control, as permitted by:

• Apple's Usage Rules outlined in the Apple Media Services Terms and Conditions.
• Google Play Terms of Service.

3. Maintenance and Support

We are solely responsible for providing maintenance and support for the application. Apple and Google have no obligation to furnish any maintenance or support services for the application.

4. Warranty

We provide the application "as is" and "as available," without any express or implied warranties. In case of a failure of the application to conform to applicable warranties:

• You may notify Apple for a refund if you purchased the application through the App Store.
• Google Play users should follow the refund procedures outlined in the Google Play Terms of Service.

5. Product Claims

You acknowledge that we, not Apple or Google, are responsible for addressing any claims relating to the application or its use, including but not limited to:

• Product liability claims.
• Claims of non-compliance with legal or regulatory requirements.
• Claims under consumer protection, privacy, or similar legislation.

6. Intellectual Property Rights

If a third party claims that Evap Mail infringes on their intellectual property rights, we are solely responsible for investigating, defending, settling, and discharging the claim.

7. Legal Compliance

You represent and warrant that:

• You are not located in a country subject to a U.S. Government embargo or designated as a "terrorist-supporting" country.
• You are not listed on any U.S. Government list of prohibited or restricted parties.

9. Third Party Terms of Agreement

You agree to comply with applicable third-party terms of agreement when using this application.

10. Third Party Beneficiary

You and we acknowledge that Apple and Google, and their respective subsidiaries, are third-party beneficiaries of this EULA. Upon your acceptance of these terms, Apple and Google will have the right to enforce the terms of this EULA against you as third-party beneficiaries.

11. Governing Law

These Terms of Service are governed by the laws of Portugal, without regard to its conflict of law principles.

12. Indemnification

You agree to indemnify and hold harmless the individual providing Evap Mail from any claims, liabilities, or expenses arising from your use of the application.

13. Changes to Terms

We reserve the right to update these Terms of Service at any time. Significant changes will be communicated through the application or other reasonable means. Continued use of the application after changes constitutes acceptance of the updated terms.
